These Terms of Service (“Terms”) govern your access to and use of usaboxesrecycle.com (the “Site”) and any products, services, quotes and communications provided by USA Boxes Recycle (“we,” “us” or “our”). By using the Site or requesting a quote, you agree to these Terms. If you do not agree, please do not use the Site.
Use of the Site
The Site and its content are provided for legitimate business inquiries. You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, scrape it at abusive volumes, or use it to transmit unlawful, infringing or harmful content. All Site content, branding and copy are owned by us or our licensors and may not be reproduced without permission.
Quotes are not binding until confirmed
Any prices, availability, lead times or specifications shown on the Site or provided in an informal reply are estimates for convenience only. A quote becomes a binding offer only once we issue a written, itemized quote and it is expressly confirmed in writing by both parties. Quotes are valid for the period stated on them and are subject to prior sale, stock availability and freight-market changes. Used inventory is sold on an as-available basis.
Used goods & product grading
We buy, sell and recondition used and new boxes, Gaylords, pallets, accessories and upcycled goods. Used products are graded (for example, A, B and C) to describe condition, and those grades are good-faith assessments, not guarantees. Used goods are pre-owned and may show normal wear, cosmetic marks, prior labels or minor variation within a grade. Except where we provide certified ratings for specific new stock (such as ECT or Mullen burst certificates), used products are sold “as is” for their described grade and intended use. You are responsible for confirming a product’s suitability for your application before use.
Freight & delivery terms
Unless otherwise stated in writing, freight quotes are estimates and delivery dates are targets, not guarantees. Title and risk of loss pass according to the shipping terms specified on the confirmed quote or order. We are not liable for carrier delays, force majeure events or damage occurring in transit once goods are tendered to the carrier. Claims for shortages or visible damage should be noted on the delivery receipt and reported to us promptly.
Payment
Payment terms are stated on each confirmed quote or invoice. Unless agreed otherwise, amounts are due as invoiced. We may hold or cancel orders for non-payment.
Disclaimer of warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, except to the extent such warranties cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, USA Boxes Recycle will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or revenues, arising out of or relating to your use of the Site, our products or these Terms. Our total liability for any claim relating to a product or order will not exceed the amount you paid for the product or order giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless USA Boxes Recycle and its personnel from claims, losses and expenses arising out of your breach of these Terms or your misuse of the Site, products or services.
Governing law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. The state and federal courts located in Utah will have jurisdiction over any dispute arising from these Terms or your use of the Site, and you consent to that jurisdiction and venue.
Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The “Last updated” date above reflects the current version.
